Mediation


There are a number of ways the process of mediation is approached.   Be advised to check out the mediator’s approach and background experience in helping resolve conflict or to influence a transaction.   Some mediators us an interest-based approach, which can make the interests of both parties as the central focus.  Using a facilitative approach, a mediator would provide assistance to neither party but help to encourage discussion and definition of the process towards a negotiated solution.  An evaluative style is often characterized by the type of negotiations used in union versus management transactions.  In such instances, it is imperative for the mediator to remain neutral and to encourage movement towards objectives and outcomes.  Still other mediators figure themselves to be more of a transformative leader who works to establish and create positive dynamics that lead to working relationships.
